Conditions for Use

Effective March 1, 2004. Subject to revision.

Non-transferable License

Customers purchasing MOREnet's e-Conferencing service acknowledge when signing the e-Conferencing order form that the use of the licenses contained therein are to be used only for events originated by them and that licenses are not transferable to other entities outside the purchasing customer's organization. Only MOREnet customers who have purchased MOREnet's e-Conferencing service may originate events.

Talent Release Statement

By logging in to the MOREnet e-Conferencing tool, I hereby consent that electronic media recordings made of me during my participation in events hosted by various organizations and enabled via the MOREnet e-Conferencing service provided by the Curators of the University of Missouri on behalf of MOREnet (hereinafter MOREnet) may be used for any purpose and copies may be distributed in whole or in part by the hosting organization, in any form of media, without compensation to me.

I hereby release the hosting organization, MOREnet, their employees and agents and any publisher of materials (and their respective licensees and assigns) that include the above mentioned recordings, from any and all claims arising out of, or related to, any publication, distribution, broadcasting transmission or any other use of such materials.

By using the MOREnet e-Conferencing tool and selecting the option to record, I hereby acknowledge and agree that I, on behalf of hosting customer, am solely responsible for any and all liability related to any electronic media recordings made of events hosted by me and enabled via the MOREnet e-Conferencing service provided by the Curators of the University of Missouri on behalf of MOREnet.

Further, should another individual participate in the delivery of the event (such as a guest speaker or discussion), I hereby certify that I have obtained the appropriate talent release, and hereby release the hosting organization, MOREnet, their employees and agents and any publisher of materials (and their respective licensees and assigns) from any and all claims arising out of, or related to, any publication, distribution, broadcasting transmission or any other use of such materials or recordings.

I hereby release the hosting organization, MOREnet, their employees and agents and any publisher of materials (and their respective licensees and assigns) that include the above mentioned recordings, from any and all claims arising out of, or related to, any publication, distribution, broadcasting transmission, or any other use of such materials.

My organization shall, unless prohibited by law, indemnify, defend and hold harmless the University, its employees, officers and agents from any and all liability, loss, damage and expenses (including attorney fees) they may suffer as a result of claims, demands, costs or judgments which may be made or instituted against them or any of them arising out of or connected with the performance of the activities or services to be provided under this acknowledgement.

FERPA Compliance

Users of MOREnet's e-Conferencing service should be aware of FERPA (Family Educational Right to Privacy Act) issues when students are shown in e-Conferencing sessions. Organizations and their representatives are responsible for ensuring compliance with FERPA requirements.

Content Ownership

MOREnet does not monitor individual events hosted via the MOREnet e-Conferencing service. MOREnet serves as a temporary custodian of event recordings and is not the owner. Organizations hosting the events are deemed to be the owners of such events.

Copyright Issues for Media Content

Media such as audio, video and still images are subject to intellectual property rights and copyright laws just as text materials are. The originating site is responsible for ensuring that notice for copyright or other intellectual property rights are properly displayed. By accessing the e-Conferencing tool, each customer has acknowledged and agreed to the following statement:

Customer shall be solely responsible for the (multimedia) content it publishes via the video streaming and e-Conferencing services provided by the Curators of the University of Missouri on behalf of MOREnet (hereinafter MOREnet). Any use of these services that are in violation of Federal, State, or Local Law is prohibited. This includes, but is not limited to, data, graphics, artwork, copyrighted/trademarked material, material legally judged to be threatening or obscene, and material protected by trade secret and other statutes.
