The landscape of AI governance just changed. A new Federal Executive Order (EO) is reshaping how public institutions use and regulate artificial intelligence. For MOREnet member organizations, the impact boils down to three main points:
1. Funding – The federal government is signaling that future technology grants may be linked to how states handle AI. If your state implements overly restrictive AI laws that the feds deem “innovation-stifling,” it could jeopardize federal funding for local infrastructure and broadband projects.
2. You Are Still Responsible for Data Privacy – Don’t let the headlines fool you: federal oversight doesn’t mean local immunity. All student data privacy laws remain fully in effect. If an AI tool leads to a data breach, your institution remains the first line of legal responsibility.
3. Prepare now – Don’t Wait for a Mandate. The next 18 months will be a period of legal uncertainty as courts define the boundaries between state and federal power. Cybersecurity experts recommend acting now:
- Audit Your Network: Identify which AI tools are currently being used by staff and students. If you’re a MOSPA/TEC member, they can help, if not, you should be.
- Enforce Safety at the Source: Use browser-level filters to prevent the input of sensitive information into unsecured AI models.
- Stay Agile: Build flexible policies that can adapt as federal guidelines evolve.
